The judgement, announced by a jury in the late afternoon, is less than the $75 million Andrews sought from from the owner and operator of the Nashville Marriott and the stalker, Michael David Barrett, who has already served a prison sentence.
Barrett will pay about $28.5 million, while the hotel will pay about $26.75 million.
Marc Dedman, an attorney for the hotel, said that his team and his clients were disappointed in the verdict. She broke down on the stand repeatedly, saying she continues to suffer because people are still watching the videos and taunting her about them. He confessed that he arranged with the hotel to stay in the room next to hers and altered the peephole in order to record her nude. Spargo said, “They told her she needed to do this because at that time no one had been arrested in the case and believed she had released the footage”.
This brings some closure to what has been a trying ordeal for Andrews, as she was harassed and bullied over this unfortunate incident.
The jury is scheduled to begin deliberating in Andrews’ civil case Monday.
He denied showing the video but did admit in a statement from his lawyers that the video was shown on a mobile device by someone else at the table. The hotel is a franchise and Marriott is not part of the trial.
Deliberations got underway at 9:24 a.m. Monday in Andrews’ lawsuit against the Vanderbilt Marriott. She has maintained that the stalker and two hotel companies were to blame. But she also said that she has changed as a person, becoming more bitter and less trustful, and that she is constantly, and unhappily, reminded of the video’s existence.
She said she thoroughly checks the bed, the clock, the air conditioning grate and especially the bathroom for hidden cameras and looks for the telltale red lights of possible hidden recorders.
Barrett didn’t show up for the trial.
In Barrett’s videotaped deposition, he said that he alone was to blame.
The jury heard Barrett say that he went to the hotel restaurant and used a house phone to ask to be connected to Andrews’s room.
